I. GENERAL PROVISIONS
1. These Terms and Conditions define the principles for using the online Shop www.postarszymbracie.pl.
2. The shop is operated by a Seller who is not an entrepreneur.

4. Personal data registered in the online Shop shall be stored and processed only for the purpose of carrying out the activities of the Shop.
II. SHOP OPERATING RULES
1. In order to use the Shop Buyers shall need:
a) A device with access to the Internet
b) An active e-mail account.
2. Buyers have the possibility to create/register an account in the Shop or make purchases without registering by entering the required data each time they place an order.
3. Registration is subject to accepting the content of the Terms and Conditions and providing the personal data marked as mandatory.
4. Customers may have their right to use the Shop withdrawn or restricted, with immediate effect, should they violate the Terms and Conditions.
III. GOODS AVAILABLE IN THE ONLINE SHOP
1. The prices presented in the Shop are the full prices of the goods and do not include the cost of delivery of goods.
2. The prices displayed in the online Shop are shown in Polish zloty.
3. The prices of the goods are valid at the time of placing the order. The Shop reserves the right to amend the prices of goods, introduce new goods, remove goods, and launch, cancel and modify promotional offers.
4. Incorrect data that does not affect the appearance and quality of the product shall not constitute grounds for any claims by Customers.
5. In the event of any inconsistency of the goods received with the photo or description, the Customer is obliged to inform the staff of the Shop by sending an e-mail to the address specified in the Terms and Conditions, within three working days of receiving the goods.
6. The pictures of goods may differ slightly from the actual features of the goods.
7. All data, descriptions and pictures presented in the Shop constitute property of the Shop within the meaning of intellectual property law and, consequently, may not be copied, distributed or used for commercial purposes or presentation on other websites without the consent of the Shop owner.
IV. PURCHASES, CONCLUSION OF A SALES CONTRACT
1. In order to conclude a sales contract via the Shop, Customers should visit the website www.postarszymbracie.pl to choose the goods, and take further technical steps based on the information displayed to the Customer and the information available on the website.
2. The goods selected for purchase should be added to the shopping cart in the Shop, or purchased using the quick purchase option.
3. An order is placed when the Buyer confirms the contents and accepts the Terms and Conditions.
4. Placing an order is treated as concluding a sales contract between the Buyer and the Seller in accordance with the Terms and Conditions.
5. Orders are accepted via the online Shop 7 days a week, 24 hours a day, except for the necessary technical breaks on the website of the Shop.
6. Orders are processed on working days.
7. After placing an order, the Customer will receive a message to the e-mail address provided by them, summarising the placed order, which is also a confirmation of the order.
8. The shop reserves the right to ask for confirmation of the order or verification of the address details provided by the Customer.
9. An invoice may be issued upon specific request of the Customer.
10. Sales via the online Shop are carried out by a Seller who is not an entrepreneur, and at the same time has no obligation to issue a fiscal proof of sale.
V. ORDER PROCESSING
1. The Seller is obliged to deliver goods in accordance with the descriptions on the website of the Shop.
2. The order delivery date is indicated in the Shop.
3. Regardless of the method of payment chosen by the Customer, the Seller shall proceed with the order after the payment has been received by the Seller.
4. Orders are processed in the order of receipt while stocks last.
5. The Shop reserves the right to decline orders. 6. Orders containing errors will be reviewed or may not be processed.
VI. PAYMENTS
1. The Buyer may choose one of the following payment options:
a) traditional bank transfer to the Seller's bank account;
b) payment card
c) via a payment platform.
2. The receipt from the payment platform or bank account constitutes proof of purchase.
3. In the event of choosing payment via a payment platform, the online payment service provider shall be Blue Media S.A.
4. In the event of difficulties with processing payments via Blue Media, www.postarszymbracie.pl shop shall not be held liable.
5. In the event of the necessity to reimburse the Buyer, the Seller shall make a refund to the bank account assigned to the Buyer's payment card.
6. If the Buyer chooses to pay in advance, the order must be paid for on the day of placing the order. Failure to do so will result in the order not being processed.
VII. DELIVERY
1. Goods purchased from the Shop are delivered according to the delivery method chosen by the Customer:
a) Via a courier company
b) Via Polish Post
c) Via Paczka w RUCHu
d) To InPost Parcel Lockers
2. Delivery shall be made to the address indicated by the Customer when placing the Order.
3. The delivery costs shall be borne by the Customer.
4. The costs of delivery are indicated on the website of the Shop.
5. The Shop is not responsible for delays caused by the delivery providers.
6. Should the package bear traces of an attempt to open it, it should be refused, a damage protocol should be drawn up together with the courier, and the Shop should be immediately informed by e-mail.
VIII. WITHDRAWAL FROM THE CONTRACT
1. Goods from the Shop www.postarszymbracie.pl are purchased from a Seller who is not an entrepreneur, and therefore the Customer is not entitled to return the goods.
2. The consumer's right of withdrawal shall not be applicable.
3. Information about the lack of the right of withdrawal from the contract shall be clearly indicated on the Seller's website.
IX. EXCHANGE OF GOODS
Due to the nature of the goods (second-hand clothing), exchanging goods is not possible.
X. PERSONAL DATA
1. The administrator of the personal data provided by the Buyer while using the Store is the Seller. The purpose of processing the Buyer's data by the Seller is to process orders. Providing data by the Buyer is voluntary but at the same time necessary to conclude the contract.
In order to exercise their rights, the Buyer should contact the Seller by using the data from the Terms and Conditions.
XI. FINAL PROVISIONS
1. Each order placed in the Shop constitutes a separate sales contract and requires acceptance of the Terms and Conditions.
2. Contracts concluded on the basis of the Terms and Conditions are concluded in Polish.
3. In the event of a dispute with the Buyer, the court with jurisdiction over the registered office of the Seller shall be the competent court.
4. In matters not regulated in these Terms and Conditions, the provisions of the Civil Code, the provisions of the Act on electronic services, and other relevant provisions of Polish law shall apply.
